論灘涂承包經(jīng)營權(quán)的效力
摘 要
灘涂承包經(jīng)營權(quán),是指公民、集體依法對集體所有的、或者國家所有由集體使用的灘涂進(jìn)行承包經(jīng)營的權(quán)利。灘涂承包經(jīng)營權(quán)的基本權(quán)利主要包括灘涂占有權(quán)、經(jīng)營自主權(quán)、經(jīng)營收益權(quán)及依法處分權(quán)等權(quán)能；基本義務(wù)主要包括不得隨便改變?yōu)┩哭r(nóng)業(yè)用途、合理開發(fā)利用灘涂、灘涂不得拋荒及負(fù)有容忍國家征收等義務(wù)。我國現(xiàn)行法律對灘涂承包經(jīng)營權(quán)的權(quán)利與義務(wù)規(guī)定還有1些不足，立法機(jī)構(gòu)應(yīng)從以下幾方面完善我國灘涂承包經(jīng)營權(quán)制度：規(guī)范灘涂所有人的行為；對公共利益進(jìn)行界定；健全補(bǔ)償機(jī)制；對灘涂承包經(jīng)營權(quán)權(quán)利的行使加以限制。

Abstract

Chinese existing laws on the beach contracting the rights and obligations provided there are some inadequacies, Legislative bodies from the following aspects Perfection shoals contract right system: all the norms shoals; to define the public interest; sound compensation mechanism; shoals of contract rights for limiting on the exercise.
